Regulation (EU) No. 2016/679, of the European Parliament and of the Council, of 27 April 2016, concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data (General Data Protection Regulation - GDPR), provides in point (a) of paragraph 1 of its Article 37 that the entity responsible for the processing of personal data must designate a Data Protection Officer whenever the processing is carried out by a public authority or body.
Law No. 58/2019, of 8 August, which ensures the implementation of that Regulation in the national legal order, provides, in the combined provisions of Article 9 and point (b) of paragraph 3 of Article 12, for the existence of at least one Data Protection Officer for each Regional Government Department, in the case of autonomous regions, who is appointed by the respective member of the Regional Government, based on the requirements set out in paragraph 5 of Article 37 of the GDPR. Considering the structure of the XIV Regional Government of the Azores, approved by Regional Regulatory Decree No. 3/2024/A, of 11 April, which created the Regional Secretariat for Parliamentary Affairs and Communities.
Therefore, pursuant to point (a) of paragraph 1 and paragraph 6 of Article 37 of the GDPR, in conjunction with point (b) of paragraph 3 of Article 12 of Decree-Law No. 58/2019, of 8 August, and point (d) of Article 2 and Article 10 of Regional Regulatory Decree No. 3/2024/A, of 11 April, and also the Order of Delegation of Competences, published under No. 650/2024, in the Official Journal, II Series, No. 73, of 12 April, and Resolution of the Government Council No. 106/2022, of 13 June, as amended by Resolution of the Government Council No. 12/2024, of 29 April, Mr. Luís Alberto Jorge Tomé, a Law graduate and senior technician assigned to the Regional Directorate of Communities, within the Regional Secretariat for Parliamentary Affairs and Communities, was appointed as Data Protection Officer for the Secretariat, performing duties as Coordinator of the Migration Support Unit, due to his proven professional qualities and the necessary skills for the role.
In carrying out his duties, the appointee will be technically supported by representatives from each service integrated into the Regional Secretariat for Parliamentary Affairs and Communities, who will be appointed by their respective heads.
