With regard to the public release of information by the National Union of Telecommunications and Audiovisual Workers - SINTTAV about the results of the inspection on RTP this Wednesday, September 6, 2023, the Regional Labour Inspectorate (IRT) hereby informs the following:
1 - SINTTAV has the legitimacy to request an inspection procedure in situations where the defence of the interests of the workers it represents are at stake, as provided for in article 16(1) of the IRT Statute;
2 - Such legitimacy confers on SINTTAV the right to be informed, whenever it so requests, about the results of the inspection procedure, as set out in article 16(2) of the aforementioned IRT Statute;
3 - Under these circumstances, the information provided must not only safeguard the secrecy of justice, but must also safeguard the rights of employers, as set out in the IRT Statute, and SINTTAV is the sole party responsible for the alleged content of the results of the inspection that has beem made public;
4 - SINTTAV was not authorised by the IRT to make the results of the inspection public, and it is true that most of the situations allegedly reported by the IRT were not mentioned at any time, namely judgments about misconduct in service provision contracts;
5 - The IRT has respected and will continue to respect the right of SINTTAV to be informed of the results of the inspection, but condemns any action that could jeopardise the secrecy of justice or the rights of the employer;
6 - The IRT only has powers to ascertain the existence or non-existence of evidence of situations that could be regarded as subordinate work, and it is up to the courts to decide, so conclusions can only be drawn after a final judgment has been delivered.
